Craig Wright, who says he’s the creator of Bitcoin (Satoshi Nakamoto), can now present his argument for copyright protection of the Bitcoin file format in the UK. Three UK judges have agreed to hear his appeal against a previous court’s rejection, as mentioned in a court filing.



On February 8, 2023, a UK Court rejected Craig Wright’s request to block the operation of Bitcoin and its fork, Bitcoin Cash, based on his claim that they violate his intellectual property rights. Wright filed the claim against 26 defendants linked to Bitcoin, including developers and entities from Coinbase, a crypto exchange. He argues that the Bitcoin Satoshi Vision blockchain, which he created from another Bitcoin fork, is the true blockchain behind the bitcoin cryptocurrency.

The Bitcoin Legal Defense Fund, established by former Twitter chief Jack Dorsey to support developers facing lawsuits, clarified that the recent ruling only allows Dr. Wright to argue that the Bitcoin file format qualifies for copyright protection under UK law. The court’s decision does not determine whether the Bitcoin file format should indeed receive copyright protection or if Dr. Wright holds the copyright.

The trial to determine whether Wright is the real creator of Bitcoin, Satoshi Nakamoto, is scheduled for January 2024. In a previous case heard in Oslo, multiple witnesses presented forensic evidence showing discrepancies in documents provided by Wright to support his claim, including the use of fonts that did not exist during the supposed time of creation.



According to the Bitcoin Legal Defense Fund, the matters concerning copyright protection will be addressed at a full trial, but only after a separate trial in early 2024 where Dr. Wright must prove that he is Satoshi Nakamoto. The Defense Fund expressed concern over the UK courts allowing such arguments, warning that it establishes a risky precedent, potentially enabling developers to face lawsuits for allegedly infringing upon the file format of open-source software claimed to be created by someone else.
