In a world where the boundaries of the digital and the physical often blur, law enforcement agencies continue to adapt their tactics in the fight against cyber-enabled crime. In a recent victory, the U.S. Attorney’s Office for the Western District of Washington announced it had seized approximately 32.68 bitcoin, then valued at $900,000, as part of a fraud investigation into a business email compromise (BEC) scheme. The fraudsters, based in Nigeria, had targeted real estate transactions, resulting in the theft of more than $1 million.
The scheme came to light in December 2023 when a company responsible for real estate transactions reported a system breach. The perpetrators had infiltrated the company’s systems to send false wire transfer instructions, effectively diverting large sums intended for mortgage and property payments. As the investigation unfolded, it became clear that at least ten individuals and businesses had suffered financial losses, with sums ranging from $75,000 to a staggering $425,000.
Following the trail of the stolen funds, investigators discovered they had been laundered through various bank accounts, including those operated by money mules, before being consolidated into a cryptocurrency wallet controlled by the fraudsters. Recognizing the volatility and potential value of the bitcoin, law enforcement acted swiftly to seize the funds, preserving their worth for the victims.
The U.S. Attorney’s Office subsequently filed a civil forfeiture case against the seized bitcoin, effectively freezing its value. Since the time of seizure, the value of the bitcoin has more than tripled. “Due to the rising price of bitcoin, it is possible that each of the ten victims who have filed claims will be made whole,” the announcement noted.
U.S. Attorney Tessa M. Gorman lauded the swift actions of law enforcement and the Asset Forfeiture Unit. “I commend the quick work by law enforcement and the Asset Forfeiture Unit who moved to seize this bitcoin and are working diligently to make these victims whole,” she stated. Gorman also emphasized the significance of civil forfeiture in cases where the criminals remain at large, labeling it an essential tool for assisting victims.
This case illustrates the increasing importance of understanding and tracking digital currencies in modern law enforcement. The substantial increase in bitcoin’s value since the seizure ensures that the victims will likely recover their full losses, providing much-needed financial relief and marking a significant victory in the ongoing battle against cyber-enabled fraud.
